Terms of Use
The data access and dissemination policy of Phytoplankton Bio-Imaging Products (hereafter Phytoplankton Bio-Imaging) shall follow the policies of the European Commission with respect to public data, and shall recognize the rights of the owners of data and algorithms and takes full account of any related ethical or legal issues;
The data policy of the Phytoplankton Bio-Imaging, when depending on contributing external data resources and/or other infrastructures will be subject to agreements with these partners in accordance with this Annex, and will be managed at the highest level as a specified task of the Platform coordination;
Phytoplankton Bio-Imaging acknowledges that part of its value as an infrastructure is based on the enhancement of the benefits of knowledge, which is in the public domain;
Users having access to data, know-how or other IPRd resource in the custody of, or generated by, Phytoplankton Bio-Imaging should acknowledge the intellectual property rights and other rights of owners vested in all submission information protocols or agreements and MoUs. Phytoplankton Bio-Imaging data users should be able to demonstrate due diligence in ensuring that rights in the data are appropriately managed;
Data, accessible through the services of Phytoplankton Bio-Imaging, may prohibit their reuse for commercial purposes and be limited to non-commercial research;
Users and service providers having access to data should acknowledge the intellectual property rights policy as stated in this Data-User Agreement;
Citation of Phytoplankton Bio-Imaging as information source will be the most common way to acknowledge the intellectual property rights and other rights of owners vested in all submission;
In the case of data sets in respect of which a third party holds intellectual property rights, Phytoplankton Bio-Imaging shall ensure that its actions are taken only with the consent of that third party;
It is the responsibility of Phytoplankton Bio-Imaging to provide guidance (e.g. via website) to researchers and their host institutions to ensure that any research undertaken using material in its custody is organised and undertaken within a framework of best practice that recognises the rights of the data subjects, the data owners and any others third parties and takes full account of any related ethical or legal issues.
